These Terms of Use (“Terms”) govern your use of the website located at simmonshomedesign.com (the “Site”), operated by Simmons Home Design (“Simmons Home Design,” “we,” “us,” or “our”). By visiting the Site, requesting a quote, or otherwise using it, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover your use of our website. They are separate from, and do not replace, the written proposal or contract you sign with us for any actual construction, repair, or installation project. If anything here conflicts with a signed project agreement, the signed agreement controls for that project.
1. Who we are
Simmons Home Design designs, builds, and repairs screen enclosures, pool enclosures, patio covers, pergolas, sunrooms, glass rooms, garage screens, and related outdoor living structures for homeowners along the Texas Gulf Coast, including the Houston, League City, and Angleton areas.
2. Using this website
You may use this Site to learn about our services, browse project photos, and request a quote. You agree to use the Site only for lawful purposes and agree not to:
- Submit false, misleading, or fraudulent information through our forms;
- Attempt to gain unauthorized access to the Site, its data, or any connected system;
- Scrape, copy, or republish Site content at scale, or interfere with the Site’s normal operation;
- Use the Site to transmit spam, malware, or unlawful content.
We may suspend or restrict access to the Site for anyone who violates these Terms.
3. Quotes, estimates, and consultations
Information on this Site — including project photos, general pricing ranges, and descriptions of our process — is provided for general reference and is not a binding offer or contract to perform work. A quote requested through the Site, or a conversation with us, is not a contract. A project begins only once you and Simmons Home Design sign a written proposal or contract setting out the scope, price, materials, and schedule for that specific project. That signed document, not this Site, governs the work.
Pricing information shown or discussed before a signed agreement is an estimate. Final pricing depends on a site visit, measurements, material availability, and the scope agreed to in your signed proposal.
4. Warranties
Where we reference a workmanship warranty on this Site (for example, our workmanship warranty on qualifying installations), the specific length, scope, and conditions of that warranty are set out in your signed project paperwork, which controls over any general statement made on this website.
Some of the materials we install — for example, screening material — carry a separate warranty from the manufacturer, such as the applicable Phifer manufacturer warranty on qualifying screen products. Manufacturer warranties are provided directly by the manufacturer under that manufacturer’s own published terms and conditions. They are separate from, and independent of, our own workmanship warranty. We do not have authority to alter, extend, or guarantee a manufacturer’s warranty terms, and any claim under a manufacturer warranty is subject to that manufacturer’s own process and requirements.
5. Intellectual property
The text, layout, graphics, and photographs on this Site are owned by Simmons Home Design or used under license, unless otherwise noted. Many photos show projects we completed for actual customers, shared with permission for marketing purposes. You may view and share pages from this Site for personal, non-commercial reference, but you may not copy, reproduce, or reuse our photos, written content, or design elements for your own commercial purposes without our prior written permission.
“Simmons Home Design” and our associated logos are our marks. Other names, logos, and marks referenced on the Site (including manufacturer names such as Phifer) belong to their respective owners and are used only to describe the products and materials we install.
6. Reviews and content you submit
If you send us a photo, testimonial, or review — whether directly, by email, or through a public platform we may reference (such as Google Reviews) — you confirm you have the right to share it and grant us permission to display or reference it on this Site and in our marketing, with attribution where appropriate. We will not use identifying details like your name and property address together without your consent.
7. Third-party services and links
This Site uses third-party services, including Google Analytics, Google reCAPTCHA, and content from our Google Business Profile, and is hosted with infrastructure provided by Hostinger and Cloudflare. Details on how these services process data are in our Privacy Policy. The Site may also link to manufacturer, permitting, or building-code resources maintained by others. We do not control those third-party sites and are not responsible for their content, accuracy, or privacy practices.
8. Disclaimer
This Site is provided “as is” and “as available.” While we try to keep it accurate and up to date, we do not guarantee that the Site will be uninterrupted, error-free, or free of typographical mistakes, or that every photo, price range, or service-area description is current at the moment you view it. To the fullest extent permitted by law, we disclaim all warranties regarding the Site itself, express or implied, beyond what is stated in a signed project agreement or an applicable manufacturer warranty.
9. Limitation of liability
To the fullest extent permitted by law, Simmons Home Design will not be liable for any indirect, incidental, or consequential damages arising from your use of this Site. This limitation does not apply to obligations we owe you under a signed project contract or an applicable manufacturer warranty, which are governed by those documents.
10. Indemnification
You agree to hold Simmons Home Design harmless from claims arising out of your misuse of the Site or your violation of these Terms, except where the claim results from our own negligence or wrongdoing.
11. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Brazoria County, Texas, unless your signed project agreement specifies otherwise for a project dispute.
12. Changes to these Terms
We may update these Terms from time to time as our services, tools, or legal obligations change. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Site after an update means you accept the revised Terms.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will stay in full effect.
